Words of Wisdom for Worried Borrowers

With problems in the mortgage lending sector dominating the news, home owners who have an adjustable-rate mortgage may be wondering if it is time to re-evaluate their financial situation.

Think carefully about your ability to handle monthly mortgage payments in the future - and make adjustments, if necessary, says Susie Irvine, president and CEO of the American Financial Services Association Education Foundation, an organization affiliated with mortgage lenders.

Here are some tips that will help to give peace of mind to borrowers with ARMs:

- Make note of the date your initial interest rate adjusts, or resets, since the monthly payment may go up substantially. You can find the reset date on your monthly statement or by reviewing your loan contract.

- Be familiar with other terms and conditions of the loan, including what type of ARM you have and if there is a fee for paying off the loan early (a prepayment penalty). See the list below prepared by AFSAEF for important terms to know. Contact your lender if you have any questions.

- If you plan to refinance before the reset date, do not wait until the last minute. Lenders need time to prepare the paperwork, check references and schedule the closing. Ideally, the refinancing process should begin two to three months prior to the reset date of the existing loan.

If borrowers already are facing financial problems, they should:

- Find out their options. These may include forbearance (when the lender postpones foreclosure to give the borrower more time to make payments), mortgage modification programs and help with selling the home before foreclosure occurs.

- Watch out for scams. Be leery of foreclosure specialists who offer to solve your problems by paying off your mortgage or providing other services for a fee.

- Contact an approved housing counseling agency. For a list of agencies approved by the U.S. Department of Housing and Urban Development provides an online list of approved agencies. Another source of help is the Homeownership Preservation Foundation, which has counselors from HUD-certified agencies and sponsors a toll-free hotline (888-995-HOPE) dedicated to preventing foreclosures.

- Fix any visible problems that might be a red flag for potential buyers, including repainting stained walls.

Watch out for the Deed Scam

If you have just purchased a new home, watch out for a deed scam that is making the rounds.

New home buyers get an official looking letter in the mail telling them that it is important to have a certified copy of their property deed. Consumer Reports warns that the companies selling these services use high pressure sales tactics and charge as much as $100.

Chances are the buyers will get a copy of their deed at closing, but if they don not, all they have to do is contact their county clerk or registrars office. The charge for a copy is less than $10. In some places, they can look at and print a noncertified copy of their deed from the Internet for free. If you feel like you have been the victim of a scam, please give us a call for some friendly advice.

Carole and I both got a chance to visit the Atrium Aventura construction site last Thursday with Yansy Checa. Both of the condominium towers at the Atrium are coming along very nice and should be ready for closing starting in the next month or so. There are still some very good deals to be had on a handful of developer units that remain. We got to see first hand how nice the views are from the East tower. Important Tax Tips for 2006

It is not too late, reduce your 2006 and/or 2007 tax bill. Here is a bakers dozen year end tax saving strategies you should consider. These are some great tips recommended by HansenHomesAventura.com

1. Consider refinancing your mortgage this year. Loan fees (i.e. points) are supposed to be deducted over the projected life of mortgage, but when the loan is paid off early in order to refinance, any remaining points not yet deducted can be deducted in that year. Mortgage refinancing can be a smart move for those of us with higher mortgage interest rates and or who want to replace an adjustable mortgage with a fixed rate product while rates are still low. In addition, if your home has appreciated since its purchase and you are currently paying for private mortgage insurance, you may no longer be required to carry it if your refinanced loan amount is less than 80% of the home’s current appraised value. Also, if you have had your current loan for some time, a larger portion of your monthly payment applies to the principle, so you have less interest to deduct than you had when you first got the mortgage. If you are among the fortunate who could use additional tax deductions, refinancing your home will mean you will have a bigger interest deduction every month, even if your payments stay about the same.

2. Make your January mortgage payment in December. You will be able to deduct the interest on that payment in 2006. Keep in mind that you’ll have less mortgage interest to deduct in 2007, however. This can also work for your 2007 property tax payments, if they are not paid by your mortgage lender and your local real estate tax authority allows early payment.

3. Take deductions for any casualty or theft losses that were not covered by insurance or paid by others.

4. Take deductions for moving expenses that aren't reimbursed if you or your spouse changed jobs and moved to another home in 2006. To qualify the new place of business must be at least 50 miles from your old place of business. The commuting distance from your old home to your old job must be added to that amount.

5. Consider starting a full or part time home-based business in 2006. Working at home sure beats commuting, and technology tools such as the Internet are making the physical location of the business less relevant (millions of homeowners are now earning a full or part time income as eBay merchants for example). Portions of the home used in business may be depreciated and portions of the cost of maintenance may be deducted. Additionally, section 179 of the Internal Revenue Code allows home based and other small businesses to expense capital equipment costs in their year of purchase (up to $108,000 in 2006). If, for example, you will need to make capital investments in computers, software, a vehicle, etc. to get your business off the ground, you will be able to write off the entire amount that year even if you finance the purchases. Keep in mind however that other IRS regulations require that your new business show an annual profit with sufficient frequency, or else you may lose the tax deduction retroactively.

Both the South and North golf courses are slated to have a complete redesign by golf legend Raymond Floyd. The South course of Turnberry should be complete by December of 2006 and the North course by January of 2007. The resort is slated to be shut down July 10, 2006 in order to have all of the renovations complete for the upcoming holiday season.
